'Does civil constitution require a coup?'

Referring to the view of Kanadoglu "the constitution is made by the constitutional assemblies", Professor Ozbudun asked: "Should there be a coup to make a new constitution?"

Özbudun responded to the claim that "nobody can touch the unchangeable items of the constitution; this is the job of constitutional assembly."

The architect of the civil constitution draft, Professor Özbudun said: "constitutional assemblies are formed after the events such as war or coup. So, should there be a coup to make a new constitution? It is defined how to change the constitution."

The chairman of the committee preparing the new constitutional bill, Professor Özbudun, said: "constitutional assemblies are formed after coup. Should there be a coup to make a new constitutional law?" in response to the view of the former chief public prosecutor of the Supreme Court of Appeals, Sabih Kanadoğlu "the constitution is made by the constitutional assemblies".

Özbudun said: "constitutional assemblies are formed after the events such as war or coup. So, should there be a coup to make a new constitution? It is defined how to change the constitution. I do not even want to get involved in such a debate. The constitutional law does not contain any provision that the new constitutional laws can not be made by normal assemblies. It is already determined how to change the constitution. It is not possible to form a constitutional assembly while the normal assembly is continuing. It would be violating the constitutional law to form a constitutional assembly now."
