Turkish Daily Taraf reported on Tuesday Turkish President Abdullah Gul decided not to make a defense to constitutional court that opened a closure case against ruling Justice and Development Party (AKP).

Daily said President Gul's decision is based on the article saying a president can not be tried except "treason".

The report stated the President sees the case against him "violation of constitution".

AK Party's defense text does not include a section regarding the President Gul.

AK Party submitted to Constitutional Court its written defense on the merits of the closure case filed against the party, on Monday.

The Constitutional Court has sent the ruling AK Party's defense to the Supreme Court of Appeals Chief Prosecutor's Office on Tueasday.

The closure case targets to ban 71 members including PM Tayyip Erdogan and President Gul from party politics for five years.
