Belgium rules against headscarf ban

The Council of State in Belgian ruled that it was illegal for some schools in the Walloon region to ban Islamic religion teachers from wearing headscarves outside of class.

The Council of State had ruled in the case of an Islamic studies teacher who filed a suit after not being allowed to enter the school since “the veil is a strong and visible religious symbol which is incompatible with impartiality."

The court ruled that, “symbols, including dress, conveying religious affiliation are primary elements of religious education, and therefore cannot be restricted only to courses.”

Welcoming the decision, a non-governmental organization named Belgium Muslim Rights called on schools to immediately implement the ruling, and expressed that all incidents of discrimination be notified to the Equal Opportunities Centre.
