In accordance with the September 21 decision on the case, the retrials of 3 defendants whose defenses were not formerly received have begun. The court has ruled that defendants Staff Major Ahmet Gokhan Rahtuvan and Captain Ali Göznek be sought out through the Interpol’s Red Notice.
Defendants retired Brigadier General Levent Ersoz, Ahmet Gokhan Rahtuvan, and Ali Goznek and their attorneys did not appear at the 10th Istanbul Heavy Penal Court hearing.
At the trial, Chief Justice Omer Diken explained that the Istanbul Security Directorate had sent a correspondence to the court stating that Rahtuvan and Goznek, who could not be reached since the beginning of the trial and whose defense could not received, had fled abroad as fugitives.
According to the Security Directorate’s correspondence, Rahtuvan flew abroad on February 26, 2009 and Goznek on September 18, 2011, both departing from Esenboga Airport in Ankara.
Chief Justice Diken also conveyed that a report had been sent to the court by the Istanbul University Faculty of Medicine Hospital saying that the other defendant, Levent Ersoz, was continuing his treatment there due to health problems.
Since being informed about the two defendants fleeing the country, the court ruled that they be pursued by having a Red Notice issued for them.
The court decreed that a letter be written to the Istanbul University Faculty of Medicine Hospital requesting that defendant Ersoz be prepared for the hearing once his health permits.
The court has expressed that a reasoned decision has been prepared regarding the Sledgehammer coup plan (“Balyoz”) case and is in the stage of being sent to the Supreme Court. But the hearing has been postponed due to the decision to await the arrest of Ahmet Gokhan Rahtuvan and Ali Goznek, who will be sought through the issue of a Red Notice for them.Last Mod: 31 Ocak 2013, 16:47
